Management of Classified Establishments

ICPEs are industrial and other concerns that are subject to specific environmental protection legislation due to the nature of their activity.

For Morocco theses establishement are subject to the following rules and regulations :

Dahir of 25 August 1914 (3 chaoual 1332) regulating unhealthy, inconvenient or dangerous establishments;
Dahir of 13 October 1933 (22 joumada II 1352)amending the Dahir of 25 August 1914 (3 chaoual 1332) regulating unhealthy, inconvenient or dangerous establishments;
Vizier Decree of 13 October 1933 (22 joumada II 1352) classifying unhealthy, inconvenient or dangerous establishments.
Classified establishments are facilities that may be unhealthy, inconvenient or dangerous as defined by the Dahir of 25 August 1914 regulating unhealthy, inconvenient or dangerous establishments.
The applicable laws and regulations in force divide these establishments into three (3) classes depending on the nature of the operations carried out there or the inconvenience they present from the point of view of public safety, health or convenience.
Operating licences for establishments in the 1st class are issued by the Department of Public Works, while those in the 2nd and 3rd classes are issued by the local authorities.
Establishments in the 1st and 2nd classes are subject to authorisation and those in the 3rd class are subject to declaration.
Since 2002, when powers were delegated to the regional Walis by Order no. 368-02 of 05/03/2002 of the Minister for Infrastructure, the management of classified establishments has been transferred to the Regional Directorates for Infrastructure and Transport, and applications for licences to operate classified establishments are submitted to these Directorates. Operating permits for 1st class classified establishments with investment projects of less than 200 million dirhams are signed by the regional Walis and those for other 1st class establishments by the Minister of Equipment and Transport or his delegate.
The Ministry is preparing a draft revision of the Dahir of 25 August 1914 regulating classified establishments, in consultation with ministerial departments and professionals involved in this sector.
